1. Agreement to Terms

By accessing or using ArtiEsq ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Not Legal Advice

ArtiEsq is not a law firm and does not provide legal advice. The documents generated by this platform are templates based on attorney-designed frameworks and do not constitute legal advice, legal representation, or the practice of law. No attorney-client relationship is created by your use of this Service.

Documents generated through the Service are starting points and may require customization for your specific circumstances, jurisdiction, or industry. For complex legal matters, disputes, or situations with significant legal consequences, we strongly recommend consulting a licensed attorney in your jurisdiction.

3. Legal Information, Self-Help Software & State Notices

3.1 ArtiEsq Is Not a Law Firm

ArtiEsq is not a law firm and does not provide legal advice, legal representation, legal opinions, or attorney review. No attorney-client relationship is formed between you and ArtiEsq, its owners, employees, contractors, template authors, technology providers, or affiliates.

Unless ArtiEsq separately and expressly states in a written attorney engagement agreement signed by you and a licensed attorney, no attorney has reviewed your individual facts, circumstances, objectives, legal rights, legal obligations, remedies, defenses, options, or legal strategy.

3.2 Self-Help Software Only

ArtiEsq provides self-help software, document-assembly tools, general legal information, and template materials. Documents generated through ArtiEsq are created from information you provide and template materials that may include state-law data, public-source information, and attorney-designed templates.

The forms, templates, software, document-generation tools, instructions, and generated documents provided by ArtiEsq are not a substitute for the advice or services of an attorney. You are responsible for determining whether any document is appropriate for your circumstances and for consulting a licensed attorney if you need legal advice.

3.3 No Legal Advice or Individualized Judgment

ArtiEsq does not advise you about which document to use, whether a document is suitable for your legal needs, how your legal rights may be affected, what legal strategy you should pursue, or how any law applies to your specific facts.

ArtiEsq may provide general information, prompts, explanations, document descriptions, or automated logic to help you use the software. That information is provided for general self-help and informational purposes only and is not legal advice.

3.4 No Attorney Review; No Guarantee of Legal Sufficiency

Documents generated through ArtiEsq are not reviewed by an attorney for your individual facts unless expressly stated in a separate written attorney engagement agreement. ArtiEsq does not guarantee that any generated document is legally sufficient, enforceable, complete, current, valid for your jurisdiction, appropriate for your intended use, or accepted by any court, agency, counterparty, financial institution, filing office, employer, landlord, tenant, business partner, or other third party.

You are solely responsible for reviewing the completed document before using, signing, filing, delivering, or relying on it.

3.5 No Attorney-Client Privilege

Communications with ArtiEsq are not communications with a lawyer and are not protected by the attorney-client privilege or attorney work-product doctrine. Do not provide ArtiEsq with information you consider privileged or confidential unless you understand and accept that ArtiEsq is not acting as your attorney.

3.6 User Responsibility for Information Provided

You are responsible for the accuracy, completeness, and legality of all information you provide. ArtiEsq generates documents based on your inputs. Incorrect, incomplete, outdated, or misleading information may result in a document that is incorrect, incomplete, ineffective, or harmful to your interests.

3.7 State-Specific Notices

Certain states regulate legal document preparation, legal document assistants, nonlawyer assistance, online legal document providers, or the unauthorized practice of law. These state-specific notices are provided to make clear that ArtiEsq is a self-help software service and not a law firm. These notices do not create an attorney-client relationship and do not mean that ArtiEsq is authorized to provide legal advice in any state.

Texas Notice

For Texas users and Texas documents: the forms, templates, software, and generated documents provided by ArtiEsq are not a substitute for the advice of an attorney.

North Carolina Notice

For North Carolina users and North Carolina documents: the forms, templates, and generated documents provided by ArtiEsq are not a substitute for the advice or services of an attorney. ArtiEsq is not a North Carolina law firm and does not provide legal advice or legal representation.

California Notice

For California users and California documents: ArtiEsq is not an attorney and may not perform the legal services that an attorney performs. ArtiEsq does not provide advice, explanation, opinion, or recommendation about possible legal rights, remedies, defenses, options, selection of forms, or legal strategies.

If ArtiEsq is ever required to operate as or through a California Legal Document Assistant, additional registration information may be provided as required by California law.

Arizona Notice

For Arizona users and Arizona documents: ArtiEsq is not a lawyer, is not employed by a lawyer, and cannot give legal advice. Communications with ArtiEsq are not protected by the attorney-client privilege.

If ArtiEsq is ever required to operate as or through an Arizona Certified Legal Document Preparer, additional certificate information may be provided as required by Arizona law.

Nevada Notice

For Nevada users and Nevada documents: ArtiEsq is not an attorney in the State of Nevada. ArtiEsq is not authorized to give legal advice or legal representation. ArtiEsq may not accept fees for giving legal advice or legal representation.

If ArtiEsq is ever required to operate as or through a Nevada document preparation service, additional registration information may be provided as required by Nevada law.

Florida Family Law Forms Notice

For Florida family-law forms: if a nonlawyer helps complete a Florida Family Law Form, Florida may require a separate Disclosure from Nonlawyer, Florida Family Law Rules of Procedure Form 12.900(a), and completion of the nonlawyer section on the applicable form. ArtiEsq’s Terms, checkout disclosures, software notices, and cover-page notices do not replace any required Florida court form.

Ohio Notice

For Ohio users and Ohio documents: ArtiEsq is not an Ohio law firm, does not provide Ohio legal advice, and does not represent that any generated document is legally sufficient for your individual circumstances. Ohio authorities have taken a restrictive view of online legal document preparation by nonlawyers. You should consult an Ohio-licensed attorney before using any generated legal document for an Ohio matter.

3.8 No Reliance Without Independent Review

Before signing, filing, delivering, or relying on any document generated through ArtiEsq, you should review it carefully and consult a licensed attorney if you have questions about your legal rights, obligations, risks, or strategy.

3.9 Acknowledgment

By using ArtiEsq, purchasing a document, generating a document, or downloading a document, you acknowledge and agree that:

  1. ArtiEsq is not a law firm.
  2. ArtiEsq does not provide legal advice or legal representation.
  3. No attorney-client relationship is formed.
  4. No attorney has reviewed your individual facts unless you have a separate written attorney engagement agreement.
  5. ArtiEsq’s forms, templates, software, and generated documents are not a substitute for the advice or services of an attorney.
  6. You are responsible for reviewing the document and determining whether it is appropriate for your intended use.
  7. You should consult a licensed attorney if you need legal advice.

4. The Service

ArtiEsq provides AI-powered legal document generation tools for small businesses. You may use the Service to generate documents on a pay-per-document basis or through a subscription plan. Features vary by plan as described on our pricing page.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

5. Accounts and Registration

Some features of the Service require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

You must provide accurate, complete, and current information when creating your account. We reserve the right to terminate accounts that contain false or misleading information.

6. Payments and Subscriptions

Pay-per-document purchases are charged at the time of checkout. Subscription plans are billed on a recurring basis (monthly or annually) beginning on the date you subscribe. All payments are processed securely through Stripe.

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period - you will retain access to subscription features until that date. We do not offer refunds for partial billing periods.

Prices are subject to change with reasonable advance notice. If we change subscription pricing, we will notify you before the change takes effect and give you the opportunity to cancel.

7. Free Document on Signup

New subscribers on any paid subscription plan are entitled to one free document upon creating an account. This offer applies once per account and is non-transferable. The free document must be generated within 30 days of account creation.

8. Intellectual Property

The document frameworks, templates, software, design, and content that make up the Service are owned by ArtiEsq and protected by applicable intellectual property laws.

Documents you generate through the Service using your own business information are yours to use for your own business purposes. You may not resell, sublicense, or distribute documents generated through the Service as templates for third parties.

9. Acceptable Use

You agree not to use the Service to:

  • Generate documents for fraudulent, illegal, or deceptive purposes
  • Violate any applicable law or regulation
  • Infringe on the intellectual property rights of others
  • Reverse engineer, scrape, or copy the Service's underlying frameworks or templates
  • Share account access with others not authorized under your plan

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that documents generated will be legally sufficient for your specific needs, jurisdiction, or circumstances. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, ArtiEsq shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or any documents generated through it. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

12. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New York, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, for significant changes, by emailing registered users. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
